Terms & Conditions

A legal disclaimer

Effective date: December 1, 2026

 

1. Welcome to Wandering Moose Photography. By placing an order or using our website WanderingMoosePhotography.ca, you agree to these Terms & Conditions. If you do not agree, do not use the website or place an order.

 

2. Definitions “Customer”, “you”, “your” — the person or company purchasing goods or downloads from us. “Digital Downloads” — files, images, templates, e-books, audio, video or other downloadable digital content sold on this site. “Custom Goods” — clothing or other items made or altered to the buyer’s specification. “Products” — collectively physical goods (including calendars, books, clothing) and Digital Downloads.

 

3. Orders and Acceptance:  All orders are subject to acceptance by us. We reserve the right to refuse or cancel any order for any reason.

 

4. Pricing & Payment:  Prices are as shown on the site at time of purchase. Payment is required at the time of order. We accept the payment methods displayed during checkout.

 

5. Digital Downloads — No Refunds / License:  All Digital Downloads are non-refundable once the download link or access is provided. By purchasing a Digital Download you are granted a non-exclusive, non-transferable license to use the digital content for personal/commercial use as specified on the product page. Resale or redistribution of the original files is prohibited unless explicitly permitted. If you believe you have not received a Digital Download after payment, contact us immediately with your order number so we can verify delivery.

 

6. Custom Clothing — No Refunds Except Proven Shipping Damage: All clothing is custom made to your order and therefore non-refundable. If an item arrives damaged due to shipping, you must notify us within 7 calendar days of delivery and provide clear photographic evidence of the damage and the packaging. We will assess and, if damage from shipping is proven, offer repair, replacement, or refund at our discretion.

 

7. Calendars & Books — No Refunds Except Proven Shipping Damage: Calendars and books are non-refundable once delivered. If goods are damaged in transit, you must report the damage within 7 calendar days of delivery with photographic evidence and the original packaging. Proven shipping damage will be remedied by replacement or refund at our discretion.

 

8. Timing & Proof for Damage Claims: To make a damage claim you must: 1. Contact us at WanderingMoose.Photography@yahoo.com within 7 days of delivery.  2. Provide your order number, photos of the damaged item, photos of the packaging, and the shipping/tracking number. 3. Keep the original packaging and item available for inspection if requested. Claims submitted after 7 days may be denied.

 

9. Returns & Exchanges Except for proven shipping damage as described above, we do not accept returns or exchanges on Digital Downloads, Custom Clothing, calendars, or books.

 

10. Cancellation Policy:  Orders for digital goods are processed immediately and cannot be cancelled. Custom clothing orders may only be cancelled within 24 hours of purchase provided production has not begun; otherwise they are non-cancellable.

 

11. Shipping: Shipping methods and costs are shown at checkout. We are not responsible for carrier delays. For physical items, retain tracking info and inspect packages at delivery.

 

12. Taxes & Duties:  You are responsible for any applicable taxes, duties, or customs charges on your order.

 

13. Intellectual Property: All website content and product images (unless otherwise stated) are owned by us. You may not use, copy or reproduce site content without permission.

 

14. Limitation of Liability:  To the fullest extent permitted by law, our liability for any claim related to products purchased is limited to the purchase price paid for the relevant product. We are not liable for indirect, incidental, or consequential damages.

 

15. Consumer Rights & Applicable Law:  These Terms are governed by the laws of Ontario, Canada. Nothing in these Terms affects your statutory rights under applicable consumer protection laws. If a consumer law requires something different, that law will apply. (See government guidance on returns and refunds.)

 

16. Dispute Resolution:  If a dispute arises, contact us first at wanderingmoose.photography@yahoo.com. If unresolved, disputes will be resolved in the courts of Ontario.

 

17. Changes to Terms:  We may update these Terms from time to time; changes take effect when posted on the site. Continued use after posting constitutes acceptance.
